White House Counsel Donald McGahn has been requested to produce evidence that senior Trump administration officials are complying with the Presidential Records Act. 

In a letter sent to McGahn on Jan. 30, 2017, Sen. Tom Carper, D-Del., expressed concerns that at least the counselor to the president, White House press secretary, chief strategist and senior counselor, and a senior adviser to the president are reported to have used accounts on a private Republican National Committee email system while serving in official capacities.

Further reports suggest emails belonging to three of these staffers have been deleted without indication of whether or not they were used for official government business, potentially violating disclosure requirements and establishing grounds for disciplinary action. 

As a ranking member of the Senate Committee on Homeland Security and Governmental Affairs Permanent Subcommittee on Investigations, Carper has asked that a list of any noncompliant employees plus written policies and procedures for ensuring Presidential Records Act standards and records preservation be drafted and distributed to staff advising and assisting the president.

An outline of steps taken and copies of written guidance are requested to be submitted to the committee by Feb. 10, 2017.
