OPM memo takes back guidance on Trump executive orders

Office of Personnel Management Director Jeff Pon told agency heads in an Aug. 29 memo to stop acting on parts of three union-targeting executive orders after a judge ruled that major components of those orders overstepped presidential power.

The memo classified as rescinded OPM guidance issued July 2018 on the enactment of such orders, as it related to the provisions ruled unsustainable by the judge.

“OPM will fully comply with Judge Jackson’s order and encourages other agencies to consult with their offices of human resources and general counsel to determine proper compliance measures based on the order. OPM will work with the U.S. Department of Justice to evaluate next steps in this litigation and will provide additional guidance to agencies as appropriate,” Pon wrote.

The judge’s ruling on the executive orders served as a major victory for federal employee unions, which claimed that enactment of the orders under OPM guidance caused “chaos” at a number of agencies.
